Welcome to Momentz Productions. These Terms of Service (“Terms”) govern your access to and use of the website (momentzproductions.com) and the booking of our DJ, photo booth, lighting, and event entertainment services (“Services”). By accessing our website, communicating with our team, or booking our Services, you agree to be bound by these Terms.

1. Scope of Services

Momentz Productions provides professional entertainment services for weddings, corporate events, school dances, and private parties. The specific services, equipment, personnel, and hours of performance will be exclusively dictated by the customized written agreement (the “Event Contract”) signed by both the client and Momentz Productions.

2. Booking, Retainers, and Payment

To secure our Services for your event date, a signed Event Contract and a non-refundable retainer are required.

  • Retainers: All retainers are non-refundable and serve to reserve our time, equipment, and personnel exclusively for your date, meaning we turn away other potential clients.

  • Final Balance: The remaining balance for all Services is due in full by the date specified in your Event Contract (typically 14 to 30 days prior to the event).

  • Late Payments: Failure to remit the final balance by the contractual deadline may result in the suspension or cancellation of Services without a refund of the retainer.

3. Cancellations & Rescheduling

Client Cancellations: If you cancel your event, written notice is required. Retainers remain non-refundable. Depending on how close the cancellation is to the event date, you may be liable for a percentage of the remaining balance as outlined in your Event Contract.

  • Rescheduling: We understand that emergencies happen. If you need to reschedule your event, we will apply your retainer to a new date, subject to our availability and the current pricing for the new date. A rescheduling fee may apply.

  • Momentz Productions Cancellations: In the highly unlikely event that Momentz Productions must cancel due to severe illness, emergency, or force majeure, we will make every reasonable effort to secure a comparable replacement DJ or service provider. If a replacement cannot be found, a full refund (including the retainer) will be issued.

4. Venue & Setup Requirements

To provide the high-energy, flawless experience you expect, we require the following from your venue:

  1. Power: Adequate, grounded, and reliable electrical power within a reasonable distance from the setup area (typically a dedicated 15-amp or 20-amp circuit).

  2. Access: Early access to the venue for setup prior to guest arrival, as well as adequate time for breakdown.

  3. Protection: If the event is outdoors, the client must provide a dry, covered, and completely weather-protected area for our staff and electronic equipment. We reserve the right to halt performance if weather conditions pose a safety hazard to our team or equipment.

5. Safe Environment & Performance Expectations

Momentz Productions strives to create an incredible atmosphere. However, the safety of our staff and equipment is paramount.

  • We reserve the right to cease performance if the environment becomes unsafe due to severe weather, aggressive or intoxicated guests, or venue hazards.

  • The client is responsible for the conduct of their guests.

6. Equipment Damage & Liability

The client assumes full financial responsibility for any damage to Momentz Productions’ equipment (including DJ gear, photo booths, lighting, and props) caused by the client, their guests, venue staff, or any third party attending the event.

7. Media & Likeness Release

Unless otherwise explicitly stated in writing by the client, Momentz Productions reserves the right to capture photos or short video clips of the dance floor, photo booth usage, and event atmosphere for promotional purposes, social media, and our website. We do our best to capture the energy of the room respectfully.

8. Force Majeure

Neither party shall be held liable for a failure or delay in performance caused by events beyond their reasonable control, including but not limited to acts of God, extreme weather, pandemics, government mandates, war, terrorism, or utility failures.

9. Governing Law

Momentz Productions is based in Illinois. These Terms and any accompanying Event Contracts shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in or serving Chicago, Illinois.
